The following notice from China’s Ministry of Commerce, issued December 3, 2024, bans the export of gallium, germanium, antimony, and superhard materials to the United States, and enacts stricter export control checks on dual-use graphite materials. This move immediately follows the U.S. announcement on December 2 of new export controls and sanctions designed to prevent sales of advanced U.S. microchips and semiconductor manufacturing equipment to China.

In accordance with the provisions of the Export Control Law of the People’s Republic of China and other relevant laws and regulations, in order to safeguard the security and interests of the nation and to honor international obligations in areas such as nonproliferation, we have decided to strengthen controls on exports of relevant dual-use items to the United States. The notice on relevant matters is as follows:
- The export of dual-use items to U.S. military users or for military uses is prohibited.
- In principle, the export of the relevant dual-use items gallium, germanium, antimony, and superhard materials to the United States is not permitted; stricter end-user and end-use checks will be implemented on exports of dual-use graphite items to the United States.
Any organization or individual of any country or region that, in violation of the aforementioned provisions, transfers or provides relevant dual-use items originally produced in the People’s Republic of China to a U.S. organization or individual, shall be investigated in accordance with the law and shall be held legally responsible.
This notice is officially in force from the date on which it was promulgated.
